The trial of an illegal immigrant accused of repeatedly raping a woman has collapsed.
Haiwad Khan had been on trial at Snaresbrook Crown Court on three counts of rape, a single count each of assault by penetration and sexual assault, two counts of battery and one of intimidation.
The jury in the case retired to consider their verdict on Monday afternoon, April 14, but a spokesman for the court said trial Recorder Richard Sutton QC had now listed it for mention on April 28 with a re-trial provisionally booked for later this year.
Khan, 25, of Wood Lane, Dagenham, is classed as an “overstayer” – meaning he is in the UK illegally – after first coming to the country from Abu Dhabi on a student visa.
He denied all the charges throughout the trial, claiming any sexual encounter between himself and the complainant was consensual.
